Welcome to Design and Biz. These Terms of Service ("Terms") govern your use of www.designandbiz.com, our free AI tools (CostWut, PermitWut, RiskWut, WattsWut), and our advisory services. By using our site or services, you agree to these Terms.

About Design and Biz

Design and Biz, LLC is an independent renovation advisory firm based in Westchester County, New York. We provide free homeowner tools and paid advisory services (Day-Zero Diagnostic and Owner Representation engagements). We are not architects, general contractors, or builders. We are not licensed to practice architecture or engineering. We provide planning, advocacy, and project oversight on the homeowner's behalf.

Our free AI tools — important disclaimer

CostWut, PermitWut, RiskWut, and WattsWut are planning tools, not professional advice. They produce estimates and informational guidance based on the data you provide, public records, and our models. The outputs are not:

  • Formal cost estimates from a licensed contractor
  • Legal opinions on permitting, zoning, or regulatory compliance
  • Engineering or architectural recommendations
  • Insurance, financial, or risk-management advice from a licensed professional

You should always verify outputs with your building department, licensed architect, engineer, contractor, attorney, or insurance agent before making decisions or committing to a project. We make no warranty that the tools' outputs are accurate, complete, or current for your specific property or jurisdiction.

Our advisory services

When you engage us for the Day-Zero Diagnostic or Owner Representation, the scope, fees, and deliverables are defined in a separate written engagement letter. The terms of that engagement letter govern the advisory relationship and take precedence over these general Terms where they conflict.

We work exclusively for you. We do not accept referral fees, commissions, or kickbacks from architects, contractors, vendors, lenders, or insurers.

Your use of the site

You agree to use the site and tools for lawful purposes only. You agree not to:

  • Use the tools or content in any way that violates applicable laws or regulations
  • Reverse-engineer, scrape, or systematically extract data from the tools
  • Misrepresent your identity or the property you're entering information about
  • Use our content, brand, or trademarks without written permission

Intellectual property

All content on the site — including text, graphics, AI tool outputs, methodologies, and design — is owned by Design and Biz or licensed to us. You may share individual blog posts and tool results for personal, non-commercial use with attribution. You may not republish our content commercially without written permission.

For paid advisory engagements, our liability is governed by the terms of the engagement letter, which limits liability to the fees paid by you for the engagement in question.

Indemnification

You agree to indemnify and hold harmless Design and Biz from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the site or tools.

Third-party links and services

Our site links to external resources and integrates with third-party services (Squarespace, Netlify, Anthropic, Twilio SendGrid, Kit, Google Analytics, scheduling tools, and others). We are not responsible for the content or practices of those third parties.

Termination

Governing law and dispute resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Westchester County, New York, and you consent to that jurisdiction and venue.
